District Attorney Becton Issues Statement On California Supreme Court Decision Regarding The Humphrey Case

Contra Costa County District Attorney Diana Becton issues a statement regarding this week’s California Supreme Court decision regarding the Humphrey case concerning the cash bail system in California:

“Yesterday’s unanimous decision by the Supreme Court is crucial for reforming the broken cash bail system in California. The growing number of defendants remaining behind bars simply because they cannot pay bail is unacceptable. No person should be forced to remain in pretrial custody simply because they cannot afford bail. Poor defendants are forced to remain behind bars awaiting their trial date. There are numerous options for pre-trial release conditions, including treatment programs, electronic home detention and counseling. We must continue to have judges consider the safety of the community and the victim’s rights during a bail hearing and review if an individual can afford the bail amount.”

Next up, California will probably start paying the defendants to stay at home while awaiting trial.

They already do as most are on welfare.

But they’re not convicted yet. What if they’re actually innocent, as a few of them are? Some people have spent more time in jail awaiting trial than they were sentenced to after a plea deal or conviction. That’s just wrong, not to mention a waste of taxpayer money.

I don’t mind home detention with monitoring, but I’m against releasing violent people right back onto the streets, especially when there’s ample evidence they’re guilty and the sentence is likely to be more than their wait for trial.

That is true, but if no bail is required in the first place, how are you going to get these offenders to go to treatment programs?

DA Becton is a living example of just about everything that is wrong with progressive judicial ideology.

This has nothing to do with the rise in crime in cities across America. We all know its mostly caused by White Supremacists. I predict 2021 will go down in the books as having some of the highest statistics for crime and especially gun violence while our politicians will focus on wrong approach to solving any of these types of crimes as usual.

Becton belongs in jail, no bail.

Wasn’t Becton the one who had a wedding, and we had to “trust her” that everyone was safe. But when businesses used the same line (but with proof) she told them it didn’t matter.

Imagine if there was an ultra-conservative billionaire who bankrolled DAs all around the country, and they all promptly enacted harsh-on-crime policies while declining to prosecute chicken-s gun crimes. Just think how the media would be screaming how our justice system had been bought, that we were living in a facist state. Ok, they do that anyway, but it would be turned up even louder.

Imagine Donald Trump Jr had been involved with the illegal purchase of a handgun, and then his wife had dumped it in a dumpster next to a high school. Then the secret service came to try to confiscate the legally mandated record of sale to protect him. Think we might hear about that story a little bit on CNN or MSNBC?

Imagine Donald Trump had narrowly beaten Biden last year. Does anyone actually think that the media and Big Tech would have a blackout policy on liberals and Democrats and their conspiracy theories about how Trump cheated? They were just running stories about how Trump was stealing mailboxes in minority neighborhoods to disenfranchise “POCs.” All memory-holed after the election of course. Does anyone actually think the Democrats wouldn’t have been ten times louder and more unhinged? If it had been Antifa at the capitol, there would have been a thousand think pieces about how it was justified.

Imagine DJTs justice department had purjered themselves to indict the incoming national security advisor. Do you think that lawyer would get a slap on the wrist by the judge?

I am so sick of the double standards. If there isn’t one set of rules for all of us, there isn’t really a country anymore, and we should stop pretending.

When these people are kept in jail they are most likely receiving a raise. Free room & board plus healthcare. Further, they can apply for unemployment and likely receive it. How could she be so cruel as to take all those benefits away from them.

Diana Becton is such a Communist fraud! She says she cares about rightfully accused and imprisoned prisoners’ rights rights over those of wrongfully imprisoned people such as a sixteen-year-old boy, Scott Dyleski, who in 2006 was framed and convicted for a murder he did NOT commit nor had any involvement in yet he still sits behind
prison bars sixteen years later. Anybody who has a scintella of brains knows that high-profile attorney Daniel Horowitz brutally killed his wife, Pamela Vitale, and along with the local and national media including his dear friend Nancy Grace, framed a boy. Becton refuses to allow another evidentiary hearing only because she doesn’t have the courage to touch that hot political hot potato. He was framed because no exculpatory evidence was allowed in his case to prove his overwhelming innocence , not to mention, the wealth of inculpatory evidence against Daniel Horowitz that was readily available but was purposely suppressed by the Lafayette investigators, the media, the Contra Costa County District Attorney’s office (then Deputy D.A. & drunkard, Hal Jewett) and Scott’s own woefully inadequate if not criminal court appointed attorney, Ellen Leonida. The FIX WAS IN in! Becton only cares about persecuting innocent prisoners and not prosecuting those who truly belong behind bars!

Person had an interaction with law enforcement resulting in charges that result in being booked into Jail. To be charged with a Felony, criminals these days really have to work hard at it. Ending up in Jail is different than it used to be, these days after FECKLESS state legislature forced it’s state’s prison overcrowding down onto all 58 CA counties. Ever since AB-109 passed in 2011 liberals have done their utmost to keep criminals on our streets to avoid embarrassment of overcrowded county Jails.

The result of felons serving multi year sentences in county jail, there are fewer beds available for pretrial confinement and convicted misdemeanor criminals serving jail time. As a result convicted misdemeanor often are kicked out long before their sentence is finished. For misdemeanor criminals a jail sentence is a minor inconvenience since overcrowding has turned CA jails into revolving door jokes.

As to electronic home detention, how many times has law enforcement arrested people dealing drugs at their home wearing ankle monitors or dealing in stolen merchandise ? AB-109 actually encouraged the use of GPS ankle monitoring.

People who post bail usually have commitments to keep from jobs to supporting a family to take care of while awaiting trail. I understand there are those that are poor and can’t afford bail but instead of doing away with bail completely why not take each case and circumstance into consideration so we’re not just letting everyone out until trial. If someone can’t afford bail but has a steady job and family to support and was otherwise a law abiding citizen waving bail may be fine. For those that have past records that show they will continue their life of crime let them sit in jail and wait.

How about if you’re released without bail under one of these other “options”, judges cannot allow a plea bargain to lesser charges?

Agreed, this is the perfect example of what is wrong with this country. We are going in the wrong direction and the loud flushing sound is getting unbearable.

We need law and order big time and if people were not breaking the laws at break neck speed all of these literal bailouts would not be necessary.

We need to step up and protect ourselves and our property. But we will then be found at fault-called out because we have principals and morals. The socialist and entitlement crowd are a disgrace.

The folks who voted for Becton are the same idiots that voted for Pelosi, Newsom, et. al. Bet if we can drill down many were backed by Soros funding.

Pretrial conditions including, home monitoring, counseling and treatment can all be done behind bars while keeping the public safe from habitual criminals.

Being behind bars offers allows a guilty offender the chance to reflect the wrong they have done and not be back on the street where vigilante justice rules putting innocent children and residents at additional risk.
