A bill authored by Bay Area legislators to end the legal distinction between spousal rape and rape is moving to the governor’s desk to be signed into law.
Assembly Bill 1171 will bring parity to the state’s rape statutes by establishing the same standard for spousal rape that currently exists in the penal code for rape, the authors said in a news release issued Wednesday by the office of state Sen. Dave Cortese.
The bill was authored by Assemblymembers Evan Low and Cristina Garcia, with Cortese listed as principal co-author.
“From the beginning of our efforts, we have been clear that rape is rape,” said Garcia. “And a marriage license is not an excuse for committing one of society’s most violent and sadistic crimes.”
An estimated 10-14 percent of married women have experienced rape by their spouses, according to the National Coalition Against Domestic Violence. “The idea that marital rape should be punished less severely is absurd and this legal loophole can’t continue to be ignored,” Cortese said.
California is one of nine states that distinguishes “spousal rape” from “rape,” according to the news release.

Under the law they are not equal. This will make it just rape instead of having two categories.

California does not prosecute criminals anyway so what’s the point we have thousands of laws on the books now we don’t need more how about we just prosecute using the existing laws I know that sounds crazy in California but the last thing we need is more laws
I didn’t know we didn’t prosecute anyone in this state. I wish someone would have told the judge while I was on jury duty. Someone should have told the defendant that as well, he wouldn’t have had to even show up if that was the case. We should test this theory of yours, why don’t you go out and rob a store or something. Just explain to the police after that this state doesn’t prosecute anyone and they should just let you go.

“What Prop 47 did is increase the dollar amount by which theft can be prosecuted as a felony from $400 to $950 to adjust for inflation and cost of living,” Bastian said. “But most shoplifting cases are under $400 dollars to begin with, so before Prop 47 and after Prop 47, there isn’t any difference.”
Also, to put into perspective, in Texas the dollar amount for a felony is at $1,500 and Arizona it is $1000. So, really what Prop 47 did was put us in line with red states. In fact, there are only 6 states that will charge a felony when it is over ~$500 (Florida being at $300). The vast majority (27 states) are at a similar level as California.
The real problem is not prosecution but working on prevention in the first place. I’d start with our education system, youth programs, mental health facilities, focus on rehabilitation not punishment to reduce recidivism, drug rehab, and a likely a dozen other programs. There isn’t going to be a single program that will magically reduce crime.

Those “solutions” have failed. They have failed because criminals today steal for profit, to resell on eBay and places like that. Or they steal to buy drugs.
You want a real fix? Stop paying women to be single mothers and make the penalties for theft harsh.
Texas Gov. Greg Abbott says that he’s going to “eliminate” rape.
But didnt elaborate on what kind of a crystal ball he’ll be using.
This law will open a can of worms. Not that it may be needed but it will be abused.
