Concord Police have released video footage from a high-risk incident in April that began with an armed bank robbery and ended with an officer-involved shooting in San Jose. The video includes dashcam and body-worn camera footage from the multi-jurisdictional pursuit and final encounter. The incident started just before 10 a.m. when two suspects robbed a credit union in Concord. Officers located the getaway vehicle and initiated a pursuit that extended onto southbound I-680. The suspects’ car eventually became disabled near Sunol, where they allegedly carjacked two separate vehicles at gunpoint and fled in one of them. The pursuit continued into San Jose, where the second stolen vehicle also became inoperable. One suspect was shot and wounded by Concord officers after grabbing a firearm that he previously dropped. The second suspect was arrested nearby by San Jose police. The released footage shows the fast-moving and dangerous nature of the incident, as well as several moments where officers held their fire despite the presence of armed suspects. The video reflects the level of restraint exercised by officers under extreme pressure, particularly during multiple armed encounters across city boundaries.

Under the SCOTUS decision in Tennessee v. Garner, 472 US (1985) this is a justified use of force likely to cause death or great bodily injury for the following reasons:
1) The person was armed and there was probable cause to believe he committed multiple felonies (bank robbery, conspiracy, felony evading etc).
2) He attempted to commit an on-view felony (attempted carjacking) in front of the police.
3) He failed to submit to the arrest when ordered to do so
4) By fleeing while armed he posed a significant danger to other people in the area as demonstrated by his willingness to attempt to commit a felony IFO the police. If he will attempt to commit a felony in front of armed police officers he will not hesitate to commit a felony upon an unarmed citizen.
5) He was a danger to the officer attempting to arrest him by fleeing while armed. At any point during the foot pursuit the officer(s) could lose their advantage and be ambushed by the armed felon.
The dangers of death or serious bodily injury to suspect were outweighed by the danger to the public and the officers if the suspect was allowed to escape.
In addition California Penal Code section 835a(b) Any peace officer who has reasonable cause to believe that the person to be arrested has committed a public offense may use objectively reasonable force to effect the arrest, to prevent escape, or to overcome resistance.
