Classic Cars Will Need A Smog Test In California After Lawmakers Reject Jay Leno Bill

Jay Leno’s star power wasn’t enough to persuade a California legislative committee to pass a measure to allow owners of classic cars like him to be exempted from the state’s rigorous smog-check requirements.

The Assembly Appropriations Committee on Friday blocked Bakersfield Republican Sen. Shannon Grove’s Senate Bill 712 from advancing for a full vote. Leno had testified in support of the measure in Sacramento earlier this year.

The committee’s members and its powerful Democratic chairperson, Assemblymember Buffy Wicks of Oakland, did not provide a reason for killing the bill during Friday’s hearing, which quickly and with little fanfare announced the fate of 260 other bills that had been placed on the committee’s so-called “suspense file.” Seventy other bills also were killed without explanation.

The Senate and Assembly’s appropriations committees, which both met Friday and rejected hundreds of bills, are supposed to be the gatekeepers for bills proposing to spend taxpayer money. But the committees’ suspense files are where hundreds of politically touchy bills die quietly each year with only a few insiders knowing the real reasons.

State officials did, however, warn the committee that the proposal could potentially cost the state money, and the state’s influential environmental organizations opposed it.

Asked why the committee killed the measure, Wicks told reporters after the hearing, “I’ll have to go back and look. I can’t remember.”
Grove said she was “deeply disappointed that once again, the California state Legislature did not prioritize California’s classic car culture and the enthusiasts who were relying on this measure to pass.”

“Sadly, today California said ‘no’ to helping preserve these rolling pieces of history and let down classic car clubs across the state from lowriders, to hot rods and every American classic in between,” she said in a statement.

The proposal, which Grove dubbed “Leno’s Law” after the former late-night talk show host and comedian, would have exempted owners of classic cars manufactured before 1981 from having to pay to have them emissions tested every two years at a certified auto shop. Classic cars also would have been exempted from passing smog tests at the time of purchase.

The exemptions would have only applied to vehicles with special “historical vehicle” license plates and would have needed to be insured as a “collector motor vehicle.”

Leno, the owner of nearly 200 classic cars, told the Senate Transportation Committee in April that smogging a classic car built before modern emissions standards is a major barrier to owning one in California.

With a modern car, it’s “plug in, get your money – boom – get out. It’s very quick to get a smog check with a modern car,” Leno said. “It’s not impossible in an older car, but it’s tricky. It takes time and often causes charges four, five, six times more than a regular car.” Leno said classic car owners struggle to even find a shop with the equipment needed to test them.

Before Friday, the bill, which had 19 Republican and four Democratic coauthors, had passed the full Senate and its only other Assembly committee with only a handful of progressive Democratic lawmakers voting against it.

Supporters included a host of California car clubs and the California Automotive Wholesalers’ Association. But clean air and environmental groups as well as the Bay Area Air Quality Management District and California Air Pollution Control Officers Association opposed it, according to the CalMatters Digital Democracy database.

State regulators also warned the measure could cost the Bureau of Automotive Repair, which oversees the state’s smog testing program, and the Department of Motor Vehicles hundreds of thousands of dollars each year. Officials cited concerns it would reduce revenue from smog check and vehicle license fees.

It also could have potentially cost the California Air Resources Board $1.2 million to hire new staff to collect updated data for air quality models and to revise California’s federally required pollution-reduction plans, according to the appropriations committee’s analysis. For comparison, industry experts noted that even smaller auto-related services—such as routine windshield replacement—require significant oversight and regulation to ensure safety and compliance. Wicks, in her introductory remarks at the start of Friday’s hearing, said the state needed to rein in costs.

“Obviously, we have an enormous amount of budget constraints still,” Wicks said. “We have to ensure that we are serving our most vulnerable folks in our communities and making sure that we are doing everything we can to put our best foot forward for a strong social safety net.”

i will never follow this rule and will drive with no license plates if i have to and just keep paying temp reg fees.F these guys.If they want to come to my house argue this its going to be on all the news what a bad idea that turned out to be because i can see them way before they see me…get it?

Carpool lanes for shared vehicles are fine by me, but I’m totally against paid lanes.

My car is 56 years old.
The equipment needed to smog it probably does not even exist anymore.

I agree with your comment.
Most of the pollutants that a car puts into the environment are created during the manufacturing process. From the mining of the iron ore, to the shipping of it in those huge Great Lakes freighters, to the smelting, the rolling of the sheet steel, the stamping of the body panels, the welding and all the other processes that go to building a car, 25 tons of pollutants are created per car. If you buy a new, efficient car (electric, diesel, hybrid, etc.) every year, you’ve reset the clock and have just put another 25 tons of pollutants into the world, which won’t be offset for years by your super-efficient car.
My 25 tons has been amortized aver the past 59 years. That’s a lot of pollution I have not created, just by continuing to drive the same old car.

Gets to assembly committee and it’s suspended.

I wonder how well the committee understood the problems it would cause. I don’t think politicians think through anything very well these days. I have a 98 Subaru with less than 135,000 miles on it. The smog guy hated to see it and told me it was because with the newer vehicles all they need to do was run it on the computer.

I guess I’m one who didn’t one of get the money trees that must’ve been handed out. Apparently about 72% of US population missed out too and we don’t have the money to replace our cars. Anyone who criticizes the 72% I work them through what happened starting with the 2008 bank bailout and the extra hardships layered by the scamdemic. And being old no one wants to hire you regardless of the experience and skills one possess. Well, the karma is on them.

Good point. The computers installed in newer cars are to facilitate smog checks. They do not reduce emissions.

So we pay for smog regulations before we’ve even take the car off the lot. And if there is a problem wrong with the computer, even if our emissions are passable, we have to pay to fix the computer in order to pass the Smog test.

They always moan and groan if they have to put the car on the dyno pre 2000 and when i had a 2000 MBZ E300 and saw them smogging it by just plugging into the computer and asked if they were going to start the smog test and they said”this is it” i realized Calif was letting the wealthy have an easy ride when the car was almost new

If every one of the vehicles covered by this never ran again, the difference in air pollution would not be measurable. The legislators who voted against the bill wouldn’t understand the concept of rational thought or science if it hit them in the face. It’s all about virtue signaling and bowing to the tree huggers.

The current smog laws are 1976 and older gas cars are exempt and 1998 and older diesel. I guess I lost track…was this law to up it to 1981? Don’t know of many cars between 1976 and 1981 that could be considered classic. My opinion only.

1976 and older are exempt, including our classic cars that are fully restored. Jay Leno has over 200 classic cars so I can see why he fought this bill. Sadly, it didn’t pass

What if we sue the state?

Bay Area Air Quality Management District (BAAQMD) opposed it. I wonder what science they used to make that decision. “…and the state’s influential environmental organizations opposed it” which means don’t cross your political donors. Disgusting.

I like Jay Leno, but he is part of the problem because he is a Democrat. He may be a
moderate, but he’s still a Democrat, and the Dems he votes for, are the ones responsible
for the state’s legislation.
The best way for an older car to pass smog is to keep it tuned with new spark plugs, and
wires. A clean, well-adjusted carburetor, correct timing, oil change, and a full tank of good
non-generic gas, is also a good idea. The car’s engine is more efficient at operating temperature, so it’s best to drive it for about 1/2 an hour before getting it smogged.

anyone notice the main reason Calif didnt agree to this is because they lose too much revenue when they allow people to not smog their cars.I have always said its a tax on your car,they dont care at all about air quality,they have been raping car owners since 1981.That smog”certificate’ all that money goes to California.The smog just gets the test fees and when it fails they lose money and the state gets nothing,and smog testing cars causes pollution,and they wont admit that.

I believe the rules remain unchanged; pre-1975 model year is still exempt. There isn’t a way my carbuereted, points-fired, cat-less 1970 can be tested.
