California’s governor has signed into law a measure banning most law enforcement officers, including ICE agents, from wearing face coverings that conceal their identities during official operations. The bill, which takes effect January 1, 2026, aims to “promote transparency and reduce fear in immigrant communities.”
Under the new law, agents are prohibited from using masks such as balaclavas, ski masks, neck gaiters, or other face‐shielding items. Exceptions are allowed in specific circumstances, including undercover operations, medical necessity, or tactical scenarios. Agents must visibly display their agency affiliation and identification. Governor Gavin Newsom said the law was a response to complaints from immigrant communities that masked agents create fear, reduce accountability, and erode trust. The governor emphasized that enforcement should always include visible identity.
Shortly after the law was signed, Tom Homan, often referred to as “Border Czar,” appeared on The Laura Ingraham Show on Fox News and declared that ICE will not comply with the mask ban. He argued that the law is unconstitutional and that ICE agents need the ability to protect their identities for safety reasons. Federal authorities have already expressed strong opposition. The Department of Homeland Security called the law “unconstitutional” and raised concerns about doxxing and threats to agent safety. Legal experts say there may be court battles ahead over whether a state law can force compliance from a federal agency.

Talk about complying with the law, what about the Supremacy Clause of the Constitution, Article VI, paragraph 2? The foundational principle of the Union that, in general, federal law takes precedence over any conflicting state law?
Congress established DHS and every other Federal law enforcement agency. The Executive branch is responsible for managing it’s Law Enforcement agencies and their functions. Policy and procedures are part and parcel of managing those law enforcement agencies established by Congress.
If a local law enforcement officer were to attempt to arrest a Federal Agent acting within the scope of their Federal authority, the local officer would also be subject to arrest and Federal prosecution. In addition the officer and their employer would be subject to 42 US Code § 1983 civil rights violation under color of authority for falsely seizing the federal agent.
Federal Courts do not care if the officer was following a state law when he interred with Federal law enforcement or not. The only question is did the local officer interfere with the Federal Agent during the performance of his official duties?
Even if the Feds acquiesce and let one of their agents get arrested and that is far from a certain proposition, a writ of Habitus Corpus and Federal Agent is released and the case is taken over by the Federal Court.
If that is not enough, in 1890 the SCOTUS has already decided in the case of In re Neagle, 135 U.S. 1 (1890) that federal agents are immune from State prosecution when acting within the scope of their federal authority.
If a State were allowed to supersede the supremacy of the Federal Government, I have to wonder why we bothered to fight the Civil War. . .
