Concord Man (Former Teacher) Faces Harsher Sentence After Jury Finds Aggravating Factors in Sex Crimes Case

A Contra Costa County jury has determined that aggravating circumstances apply in the case of Nicholas Brandon Moseby, a former Danville middle school teacher previously convicted of sex crimes involving minors. Moseby, 41, of Concord, was found guilty on October 17, 2025, during the first phase of his bifurcated trial. His convictions include one felony count of lewd acts upon a child, one felony count of distributing or showing pornography to a minor, and three misdemeanor counts related to child molestation and sexual battery. Jurors were unable to reach a verdict on an additional felony lewd act charge, and Moseby was acquitted on a separate count of the same offense.

During the second phase of the trial, jurors found that the crimes involved a particularly vulnerable victim, demonstrated planning and sophistication, and that Moseby exploited a position of trust to commit the offenses. The jury could not reach a decision on whether his prior convictions showed an escalating pattern of criminal behavior, prompting Judge John W. Kennedy to declare a mistrial on that point. The findings allow the court to impose a harsher sentence when Moseby appears for sentencing on December 19 at 8:30 a.m. at the A.F. Bray Courthouse in Martinez. The case began in September 2022 after a minor victim reported the abuse to authorities. An investigation by the Contra Costa County Internet Crimes Against Children Task Force led to additional victims coming forward. Moseby was arrested on September 14, 2022, and charged two days later. Deputy District Attorney Jessica Murad prosecuted the case. At the time of his arrest, Moseby was employed as a biology teacher at Diablo Vista Middle School in Danville and as a cheerleading instructor at Nor Cal Elites in San Ramon.

I can think of an appropriate harsher sentence, but unfortunately it’s against the
Eighth Amendment, which prohibits cruel and unusual punishment.

How can a convicted child molester receive punishment that’s anything crueler than what he was convicted of?

Absolutely disgusting. Pedophiles need to be publicly executed or at least donated to science so studies can be conducted to eliminate these POS from the population. Taking advantage of vulnerable children for sexual gratification is something I will never understand. What a waste of oxygen. Can’t wait to hear of prison justice.

Too many people in power want to open the doors to younger (mostly female) kids. Try being a decent looking woman — I was being hit on by older, white, conservative, religious men when I was young as 6 years-old. Nope. No one wants to open the doors to young female children, except a certain segment. Just like WE don’t want MEN in the bathrooms with our girls, WE also do NOT want to recognize pedophiles as “minor attracted persons.” Seriously.

Honestly, I would trust a gay man or trans woman in the bathroom with my daughter’s way before a typical far right straight man.

None of them belong in a women’s bathroom!

The reason there is no headway on such atrocities is we have elected officials like Scott Weiner and Gavin Newsom. They promote and/or sign legislation giving pedophiles more access to children. And then you have the judges that release first time offenders to do more damage.
