A man has been charged with murder nearly two years after a 20-year-old Orinda resident died from a fatal fentanyl overdose, according to the Contra Costa County Sheriff’s Office. The death occurred in September 2024 and was later determined to have been caused by acute fentanyl and para-fluorofentanyl intoxication. During the investigation, detectives traced the drugs to the person who allegedly sold them to the victim. Authorities arrested 26-year-old Ulzii Orshikh Batsukh of Alameda on Tuesday after obtaining a Ramey arrest warrant. He was booked into the Martinez Detention Facility on a murder charge. Prosecutors with the Contra Costa County District Attorney’s Office have formally charged Batsukh with murder, alleging he sold narcotics laced with fentanyl that led to the victim’s death. He is being held without bail.

One thing to keep in mind
Mongolian name, I wonder if here illegally. It seems odd that unless he knowingly laced whatever with fentanyl (I am painfully naive about the drug scene, I know the names, and that is about it) to charge him with murder, I (again, naively) thought there had to be intent.
I believe intent applies to 1st, and 2nd degree murder, and maybe
voluntary manslaughter which is murder in the heat of passion.
When a human being dies during the commission of a crime, even
if it’s a heart attack, the perpetrator can be charged with murder.
Since selling or providing drugs is a crime, It is my guess he will be
charged with involuntary manslaughter.
