A 36-year-old Martinez man has been arrested on suspicion of murder in connection with a fatal stabbing on Francis Court, according to the Martinez Police Department. Police identified the suspect as Marcos Iriarte-Valdez, a resident of the 1600 block of Ashwood Drive. Following the homicide, investigators worked with community members and other law enforcement agencies to identify a license plate connected to the case. The vehicle was later located on Ashwood Drive, where officers began surveillance while detectives continued their investigation.
According to Martinez Police, Iriarte-Valdez was already on pretrial release in connection with residential burglaries that allegedly occurred April 29 in Orinda while residents were present.
Police said Iriarte-Valdez was taken into custody Aug. 4 for allegedly violating a home detention monitoring rule. The following day, Aug. 5, he was ordered released on his own recognizance and referred back to home detention monitoring. As the homicide investigation progressed, detectives obtained an arrest warrant for Iriarte-Valdez on suspicion of murder and committing a felony while released on his own recognizance. Search warrants were also obtained for his home and vehicle.
At approximately 6:23 p.m. Friday, Aug. 7, the Central County SWAT team executed the warrants and took Iriarte-Valdez into custody. He is being booked into jail with bail set at $1.1 million. And the Democrat politicians and their supporters who have created the problem of criminals out and about in our communities, instead of being incarcerated.
I can’t but wonder if Iriarte-Valdez was illegally in the country. And he’s released on pre-trial for other crimes where he’s able to do a murder. Something’s wrong with our system. And the innocent, law abiding responsible, tax paying public is who is suffering from it.

He violated his home detention. So, what’s the penalty? Return him to home detention? If this guy had been held until his court case, this wouldn’t have happened!
This kind of crap isn’t going to stop until someone sues the judge in civil court.
Judges have total immunity and cannot be punished or held liable for things like this.

Judges can be sued in federal court under USC 42.21.1.1983 if they acted outside their jurisdiction. However, it is extremely difficult and rare for this to be successful.

This is why legislative immunity, judicial immunity, prosecutorial immunity, and especially qualified immunity needs to be abolished!!!
Judges do enjoy board qualified immunity; However, it is not total. Any act that is later determined to be a “non-judicial, law enforcement act” can strip a judge of their qualified immunity.
For example a West Virginia family court Judge Louise Goldston did not have judicial immunity after she personally led a warrantless search of a litigant’s home during a divorce proceeding. She was not criminally convicted, but faced a civil rights lawsuit, a state supreme court fine, and forced retirement.

That simple fact of entering an occupied home should have given the “system”
pause to reflect upon criminal’s resolve and probable willingness to use violence,
had there been a confrontation with home owners.
