The Walnut Creek City Council will decide Tuesday night whether to overturn the Planning Commission’s denial of a permit for an unhosted short-term rental in a residential neighborhood. The dispute involves a single-family home at 635 Mandarin Lane, where applicant Hector Krauss is seeking a conditional use permit allowing the property to operate as an unhosted short-term rental. An unhosted short-term rental is similar to an Airbnb or Vrbo, where guests rent a home for a short stay without the owner or host staying at the property with them.
The Walnut Creek Planning Commission considered the application on May 28 and voted to deny the permit, finding the existing operation did not satisfy requirements necessary for approval of the conditional use permit and the city’s Bed and Breakfast Inn findings. The commission formally adopted its denial on June 11. Krauss filed an appeal on June 4, sending the issue to the City Council. The council will consider the matter “de novo,” meaning it will consider the application anew based on the record and information presented at the appeal hearing. The hearing is scheduled during the Walnut Creek City Council meeting beginning at 6 p.m. Tuesday at City Hall, 1666 N. Main Street.
A big “no” ….. despite their rule of no parties in the rentals they go on anyway …. from experience …. and really do attract the undesirables as well
