Oakland Man Charged With Burglary, Possession Of Grenade Launcher, Drugs In Contra Costa County

Brentwood police said Monday a man has been charged with multiple counts of burglary related to a rash of commercial burglaries along the Lone Tree corridor in January.

Marcus Palacios, 49, of Oakland, faces multiple burglary, drug possession, and vandalism charges. He also faces charges of possessing an explosive device, after Oakley police found a grenade launcher in Palacios’ vehicle.

On the evening of Feb. 17, police located Palacios’ vehicle and pulled him over. Police said a vehicle search revealed more than 4 ounces of suspected methamphetamine and fentanyl, packaged consistent with the purpose of sale.

Police said additional evidence related to the burglaries was found in the vehicle and they expect to make more arrests related to the burglaries.

Police said the Contra Costa County District Attorney’s office filed charges on Feb. 22, as well as charges related to burglaries that occurred in August 2023.

Palacios remains in custody pending a preliminary hearing. His bail is set at $420,000.

Something’s not right in this report. Owning a grenade launcher is not illegal. It is not an explosive device in itself. But since the charge mentioned was for possessing an explosive device, I would assume a grenade was what was possessed and the result of the charge???

Destructive Devices –

California Penal Code § 16460 (a)(2) -Any bomb, grenade, explosive missile, or similar device or ANY LAUNCHING DEVICE therefor.

California Penal Code § 16460 (a)(4) – Any rocket, rocket-propelled projectile, or similar device of a diameter greater than 0.60 inch, or ANY LAUNCHING DEVICE therefor, and any rocket, rocket-propelled projectile, or similar device containing any explosive or incendiary material or any other chemical substance, other than the propellant for that device, except those devices as are designed primarily for emergency or distress signaling purposes.

Possession of a grenade launcher is a wobbler punishable by 1 year county jail or 16 months, 2 or 3 years in State Prison. You would be required to serve at least 50% of your time in custody for this offense. You could also be subject to fines upwards of $10,000 for a conviction under this section as a felony.

California Penal Code §18715 is an sentencing enhancement if the device was possessed maliciously or recklessly in or near:

A public street or highway, Any theater, hall, school, college, church, hotel, or other public building,
Any private residence, Any aircraft, passenger train, car, cable car, or vessel that carries passengers for hire, or
Any other public place is ordinarily passed by people.

If any of these sections are shown, you could now be sentenced to up to 2, 4, or 6 additional years in a State Prison.

I’m not a law scholar, so I could be wrong, but I believe possessing a firearm while in possession of illegal drugs is a felony, even if the firearm is legal.

He probably stole the launcher during one of his burglaries and now is being charged with its possession. That’s comedy right there.

It could be from Afghanistan, Vietnam or even Ukraine where millions of dollars of weaponry are unaccounted. But also a could have been a replica or non-functioning antique that the police are using to enhance the charges. If they haven’t released a photo, I’d suspect that to be the case.
