Martinez Police responded to Home Depot on Arnold Dr. this afternoon after a report came in about a domestic disturbance involving a sawed-off shotgun.
When officers arrived, the suspect ran into the store.
Police began evacuating the store and surrounded it. During the initial evacuation process, the suspect tried to escape and assaulted an employee in the process.
Officers chased the suspect through the store and detained him.
No shots were fired and the employee was uninjured.
The suspect was booked into the Martinez Detention Facility. His identity wasn’t released by the Martinez Police Department.

The worst part of that story was “no shots fired.” Too bad the officers drop that dude and be done with him. I am betting we will be reading about him again someday soon.

Oh, and by the way, trying to carry a handgun legally by getting a CCW permit is tough to do in this County. Hopefully the Sheriff will reconsider his stance.
So, that shotgun is both a California and federal felony for barrel length and overall length. Federal law tightly restricts them (NFA, GCA), and California law outright forbids them.
What I want to know is, are they going to throw the book at this guy like they should, or will he be out in a year or two to continue his old ways?
Why bother having gun laws if the actual dirtbags in clear violation of them are back on the streets after violating them?

The point I was intending to make is, we are constantly deluged with new gun laws and restrictions in this state, bans and attempts to ban, things that turn law abiding citizens into felons if they aren’t paying attention to the news. But when a clear criminal commits a crime under some of our oldest gun laws, they never go away for more than a year or two.
Why can’t we aggressively police and punish the hardened criminals who commit 90% of the crime before the state starts targeting me with new laws?
Something like that used to be called a whippet, in the old days. They could be cut down shorter than that if they had a double barrel, but the principle’s the same. Nasty, and dangerous to the user, too. Glad they got this guy.

Absolutely legal. Barrel only needs to be 14 inches. I’ve had one, two actually slightly different models. Know what your talking about before putting your mouth and fingers in motion.

Sorry Joe, but it is both a federal and state crime to posses a sawed off shotgun that has a barrel less than 18 inches, and the gun pictured is less than 18 inches. It is also illegal in California to posses any other rifle with a barrel of less than 16 inches.

The shockwave shotguns have a “birds head grip” that takes it outside the shotgun regulations and makes them an “any other weapon” category gun, if I recall correctly.
Taking a standard shotgun and sawing off the stock and cutting the barrel shorter than 18 inches is very much a felony.
This is what the ATF informant got Randy Weaver to do, and they ended up killing his wife and kid in the standoff.
The gun pictured is not a legal gun. It is not a Mossberg shockwave. The stock had been cut and not manufactured to extend the size of the gun to 26+ inches. Compare this gun to the one in in the link that Joe m provided.

I am shocked – given how we are told that people can use spoons to kill people – I am always amazed that people go to all of the trouble and expense to get a gun – when you can get a spoon from a store for literally $1 plus tax.
But then what would the pearl clutchers have to whine about?
But wait, doesn’t the left keep telling us it’s easier to buy a gun than a head of broccoli, or something like that? Now, suddenly, it takes a lot of trouble and expense? Criminals must choose guns because there’s no “Spoon Show Loophole” to make it so easy to obtain spoons.

The question is was the gun legal at some point, who sold it originally, who bought it, and how did he get it? Enforce those laws.

This was originally a legal firearm but it has been altered to be less than 26″ long and with a barrel less than 18″ long.
That violates federal law requirements and makes it an illegal weapon.

This guy should be prosecuted as a terrorist – since he entered the store with innocent people and scared the hell out of them, not to mention the poor employee who was assaulted! All you gun lovers need to get your heads checked – this behavior is not defensible in any way.

What political goals was he pursuing in this act? This story certainly didn’t make us aware of any.
So that single weapon could spring three felony charges I would think. One for whoever modified it, one for whoever stole it, and one for the person who was caught possessing it. Ideally that would be all the same person, but…

I got one would like to know what he is charged with, if he plea bargains & what he gets.
With the current DA, I wouldn’t be surprised if he plea bargains/narcs & only spends a few months in lock up
I feel sorry for his domestic partner; hopefully he or she severs contact and moves on. It will be interesting to see what else they find when they search his home. A guy with a weapon like that likely has other dangerous toys.
Legal or not…..it looks like an effective home protection unit. Gets the bad guy and not your neighbor two houses away, like your Dirty Harry Special.
