Proposed Bill Would Create Guidelines For Religious Clothing For Inmates In California

A new bill proposed in the state Legislature could grant religious protections for incarcerated people in California.

Senate Bill 309 would create a uniform state policy that provides clear guidelines on religious clothing, headwear and grooming for inmates.

“Incarcerated Californians maintain basic civil liberties while they serve their time,” said state Sen. Dave Cortese, D-San Jose, who introduced the bill this week.

“SB 309 would ensure that Muslims, Sikhs, Jews and other religious minorities should preserve their right to religious dress and practice without harm or disruption.”

The California Department of Corrections and Rehabilitation currently has policies that mention the right to certain religious clothing and headwear, but those rules are limited to state-run facilities.

Individual local detention facilities have their own policies and procedures. That means that there is no guarantee that an inmate would be allowed to dress according to their religion from one detention facility to the next within the state.

“When a person enters into custody and they are stripped of their religious clothing, they are also stripped of their identity. No one should be forced to fight for their faith,” said Assembly Majority Leader Eloise Gomez Reyes.

A statement from Cortese’s office said that studies show that allowing this form of religious exercise reduces violence and “other negative behaviors” in correctional facilities and lowers recidivism.

Hey DemocRAT,

They are in PRISON. They should have no rights beyond shelter, food and not be beat daily. They are in PRSION. If they were really religious … would they be killing, raping, stealing etc … They are NOT in PRISON because they were following their faith.

I find it ridiculous that folks want the criminals have a nice time in PRISON. The criminals have a better life than our students, children, poor and homeless.

.
Lawmakers tend to be naive and leave loopholes or write laws so tight it becomes filled with red tape.
.
“… unless that religious clothing, headress, or grooming is deemed unsafe and explicitly prohibited by the executive facility official or prohibited by the State.”

Wear what they want? What about the little known Religion of the Metal Hacksaw that might lead to potential escape attempts?

TDL: Real concern, but you are being ridiculous! I am more worried about rhe habits of certain nuns.whose hats would enable them to fly right out of prison on windy days!

Well….. it’s OK by me but they’ll have to include everyone. VooDoo, Wicken, Hoodoo, Satanists, Protestant snake handlers, etc.
They’re going to need some live chickens for sacrifice and ceremonies too.
I’d be especially concerned with those Sikhs who have taken Amrit & must carry a Kirpan ! (that’s a dagger or short sword). That can’t be good in a prison setting.

Feed them, “house” them and provide the basic needs for SURVIVAL but outside of that they deserve nothing more. They committed their crimes and now must pay for them by being removed from society for how ever long they have been sentenced…..and that should be all there is to it in my view.

I wish this boob of a State Senator were kidding. It’s not like they did nothing to get into Prison. From what I have heard it’s very difficult to get into state Prison, County Jail no.

Continue tp provide only one code of dress for each and every convict..confusion reigns when the convict next to you looks better in their “religious get up” then they do….their walk with their chosen is internal, NOT external or should be.

Religion is in the heart and soul
Clothing, hats , beads whatever , not important if your sincere
More important things to focus on Senator
More grandstanding and trying to make a name for themselves

I believe they should have a choice.
“Will that be black horizontal stripes, or white horizontal stripes?”
“No, they aren’t available with darts; sorry no culottes either.”
