Bill Signed To End Mandatory Minimum Jail Sentences For Non-Violent Drug Offenses

Gov. Gavin Newsom signed a bill authored by state Sen. Scott Wiener, D-San Francisco, that ends mandatory minimum jail sentences for non-violent drug offenses.

Wiener said Senate Bill 73 will help end mass incarceration and what he called the state’s war on drugs.
“Our prisons and jails are filled with people — particularly from communities of color — who have committed low-level, nonviolent drug offenses and who would be much better served by non-carceral options like probation, rehabilitation and treatment,” he said.

The legislation goes into effect Jan. 1.

The law will allow courts to grant probation or suspend sentences — a practice currently prohibited by state law — for people convicted of non-violent drug offenses and would impose state-mandated programs, according to an analysis by the state’s legislative’s counsel.

Why not just stop arresting and prosecuting people for anything and just let everyone do what they want?

So, this illegal alien truck driver from El Salvador who was just sentenced to 3 1/2 years for transporting 15 kilos of fentanyl across the country — had he not broken federal law, he would be set free under Wiener’s bill?

On the bright side, he faces deportation when he is released. He will no doubt cross the border again illegally.

The reason why fentanyl is a problem to begin with is because of drug prohibition.

We’ve known this for over 100 years after alcohol was briefly made illegal – if people want to consume a substance they will find a way (bathtub gin is an example). The war on drugs is a complete failure and hasn’t curbed any drug use whatsoever – the problem has only gotten worse over the course of almost 50 years. All it has done is imprisoned millions and created incentives to manufacture drugs like fentanyl for use as an adulterant with other drugs for increased profits at the expense of safety. This leads to thousands of overdoses per year in the US alone. Commercial production will crush international drug smuggling overnight.

Legalize all drugs and produce them on a commercial scale. We’re all adults here and should be allowed to do dangerous things in a truly free country.

Drug laws here make absolutely no sense – alcohol, for example, is considerably more dangerous than cocaine when considering both short, long term effects and deaths. 95,000 alcohol related deaths occured in the US last year which is more than all illegal drugs combined. And yet, alcohol use is extremely common and encouraged in many social environments.

It’s a nice little theory liberally seasoned with bull$hit and wishful thinking. Reality doesn’t work this way.

Alcohol prohibition worked exactly as intended, i. e. it significantly reduced per capita alcohol consumption. To about 30% of pre-prohibition levels in the first years, to about 70% of pre-prohibition level in the last year. Per-capita alcohol consumption didn’t return to pre-prohibition levels until early 70s. Alcohol-related mortality closely followed alcohol consumption trends.

It’s not true that alcohol is considerably more dangerous than cocaine. It’s not true that alcohol-related deaths exceed those of all illegal drugs combined. Alcohol-related deaths include deaths from all causes related to alcohol consumption including alcohol-impaired driving and other accidents, liver cirrhosis, etc. The only deaths attributed to illegal drugs are straight overdoses; other drug-related deaths aren’t even counted. It’s the usual trick of comparing apples to oranges, which should be obvious to anyone with half a brain.

It’s not true that “commercial production will crush international drug smuggling overnight”. As we’ve seen with marijuana, it’s not what happened at all. In reality drug cartels started growing it illegally in CA – and are still successfully competing with legitimate providers.

The only correct thing you’ve said is that our current drug-related policies are stupid. Which doesn’t mean that making all drugs legal will magically improve things because “we’re all adults here”. European countries that managed to stem their drug epidemics (like Portugal) had a balanced policies centering at various harm reduction strategies. Those that didn’t have such policies failed. As will this newest Weiner’s brainchild.

“Drug harms in the UK: a multicriteria decision analysis” published in the medical journal The Lancet in 2010 found that alcohol was 3x more harmful than cocaine.

They also found that alcohol was by far the most harmful drug studied (against 20 other drugs including crack, meth, and heroin) when considering all consequences combined.

Care to talk about how much organized crime alcohol prohibition created?

Marijuana is one of the only plant based drugs that can be grown in the United States. That’s why you will never see illegal poppy or coca farms anywhere here.

Legalizing drugs will absolutely crush international smuggling while also increasing the safety profiles of recreational drugs. Divert all the money from drug incarceration to safe drug use and rehabilitation.

What happened to ‘do the crime, do the time’?

Not sure why some folks (Bob) think this is great? Why do we even have laws on the books that we are not going to enforce? In today’s screwed up state of California, I can be convicted of a crime and do no time, while suing the cops because the offended me. I no longer need to stop at a stop sign in Berkeley in a car, or in our county on a bike, … just need to slow down. The jails are too full, so let the creeps out ..

Chaos rules this state … the one positive, Newscum actually signed a Bill and not just another mandate.

You’re blowing it way out of proportion. It doesn’t even decriminalize drugs, it just frees up the judges when it comes to sentencing.
Personally, I say that if there’s no victim, then there’s no crime; but that’s beyond the scope of this topic.
Putting people in cages for non-violent drug charges is obscene.

The prison for profit industry, prosecutors, police union got wiener by the balls! now police don’t have to bust non violence drug offenses which is good for them because decreases theirs chance of being shot; no arrests = no prosecutions; no prosecutions=no crowed prison, which is unconstitutional according the the Supreme Court.

Great, more chances my house will get robbed by the non-violent drug addicts that will be roaming the streets. Sunday night some creep rang my doorbell 3 times, I turned on the porch light and he asked where is Safeway. Swear someone coached him to say that in English as he didn’t understand a word I said. I pointed, as he held a flip phone by his head. Thought he was getting coached by someone. He walked away with his dark clothes on wearing an empty backpack. I really felt violated.

what does crook weiner define as “mass incarceration?” If the offense is considered “low-level,” what type of rehabilitation is that? Probation? Sentence to probation for a crime that will not lead to jail anyway? What are they going to treat? Success rates for drug treatment typically are about 2-20%. So, as WC-Creeker and others have said, this just opens we law abiding citizens up for pleasant visits in the middle of the night as our property is non-violently removed from our possession.

I don’t care about those who use drugs, its their body, and theirs to abuse as they wish. What I am concerned about, ..the lengths addicts will go to get the money to purchase the drugs. IF society were to allow the drug addicts to do “their thing”, society should also hold those who commit “property crimes” and/or “acts of violence” (reasons don’t matter) accountable to the degree of felony.
